1. Acceptance of Terms

Welcome to Bookbox! These Terms of Service ("Terms") constitute a legally binding agreement between you and Storybox Labs LLC ("Company," "we," "our," or "us") governing your access to and use of the Bookbox mobile application (the "App") and our website at mybookbox.co (the "Website").

By downloading, installing, or using the App, or by accessing the Website, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not use our services.

We reserve the right to modify these Terms at any time. Your continued use of the App or Website after any changes constitutes acceptance of the new Terms.

3. Eligibility and Account Registration

3.1 Age Requirements

Bookbox is intended for children ages 3-10 under parental supervision. Account registration requires a parent or guardian who is at least 18 years of age (or the age of majority in their jurisdiction).

3.2 Account Creation

To use certain features of Bookbox, you must create an account. You may register using:

• Email address and password
• Apple Sign-In
• Google Sign-In

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access or use of your account.

4. Description of Service

Bookbox is an interactive storytelling application that allows children to create personalized illustrated stories through voice input. Key features include:

• Voice-to-Story: Children speak story ideas which are transcribed and used to generate stories
• Illustrated Content: Each story includes unique illustrations generated for that story
• Story Library: Created stories are saved to the user's account and device
• Offline Reading: Saved stories can be read without an internet connection
• Cloud Backup: Stories are securely backed up to the user's account

5. User Accounts and Responsibilities

As a user of Bookbox, you agree to:

• Use the App only for lawful purposes and in accordance with these Terms
• Not attempt to circumvent any content filtering or safety measures
• Not use the App in any manner that could damage, disable, or impair the service
• Not attempt to gain unauthorized access to any portion of the App or its systems
• Supervise children's use of the App as appropriate
• Report any bugs, errors, or inappropriate content to us promptly

7. Acceptable Use Policy

You agree to use Bookbox only for its intended purpose: creating fun, age-appropriate stories for children. You may not use the App to:

• Generate content that is harmful, threatening, abusive, or inappropriate
• Attempt to bypass content filters or safety measures
• Use the service for any commercial purpose without authorization
• Reverse engineer, decompile, or disassemble any aspect of the App
• Transmit viruses, malware, or other harmful code
• Interfere with or disrupt the integrity of our servers or networks

8. Prohibited Conduct

The following conduct is strictly prohibited:

• Using the App for any illegal purpose
• Attempting to create content that sexualizes, exploits, or harms children
• Harassing, threatening, or abusing other users
• Impersonating any person or entity
• Collecting or harvesting user data without permission
• Using automated systems to access the App without authorization
• Circumventing measures designed to prevent or restrict access

Violation of these prohibitions may result in immediate termination of your account and may be reported to appropriate authorities.

9. Intellectual Property

9.1 Our Intellectual Property

The App, Website, and all content, features, and functionality (including but not limited to the design, text, graphics, logos, icons, images, audio, video, software, and the arrangement thereof) are owned by Storybox Labs LLC and are protected by copyright, trademark, and other intellectual property laws.

9.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for personal, non-commercial purposes in accordance with these Terms.

9.3 Trademarks

"Bookbox," "Boxy," our logo, and other marks are trademarks of Storybox Labs LLC. You may not use these trademarks without our prior written permission.

10. Third-Party Services

Bookbox relies on third-party services to operate:

• Supabase: Database and authentication services
• Google Gemini: Story and illustration generation
• Apple/Google Sign-In: Authentication services

These third-party services are governed by their own terms and privacy policies. We are not responsible for the practices of these third-party services, though we select partners that meet our standards for security and privacy.

11. Subscription and Payment Terms

Bookbox may offer subscription plans or in-app purchases. If you make a purchase:

• All payments are processed through Apple's App Store
• You agree to pay all applicable fees and taxes
• Subscriptions automatically renew unless cancelled before the renewal date
• You may manage subscriptions and cancel auto-renewal in your App Store settings
• Refunds are subject to Apple's refund policies

We reserve the right to change pricing at any time. Price changes will not affect active subscription periods but will apply to renewals.

12. Termination

12.1 Termination by You

You may stop using Bookbox at any time. To delete your account, contact us at support@mybookbox.co or use the account deletion feature in the App settings.

12.2 Termination by Us

We may suspend or terminate your account and access to the App at any time, without prior notice, for conduct that we believe:

• Violates these Terms or our policies
• Is harmful to other users, third parties, or our business
• Involves fraud or misuse of the service

12.3 Effect of Termination

Upon termination, your right to use the App will immediately cease. Any stories stored locally on your device will remain accessible, but cloud backup and sync features will no longer function. We may delete your account data in accordance with our Privacy Policy.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STORYBOX LABS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims arising from or relating to these Terms or your use of the App shall not exceed the greater of:

• The amount you paid us in the 12 months before the claim arose, or
• One hundred U.S. dollars ($100)

Some jurisdictions do not allow limitations on implied warranties or exclusion of certain damages, so the above limitations may not apply to you.

15. Indemnification

You agree to indemnify, defend, and hold harmless Storybox Labs LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit or create through the App.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the federal or state courts located in Delaware, and you consent to the personal jurisdiction of such courts.

17. Dispute Resolution

17.1 Informal Resolution

Before filing any formal legal claim, you agree to contact us at legal@mybookbox.co and attempt to resolve the dispute informally for at least 30 days.

17.2 Arbitration Agreement

If informal resolution is unsuccessful, any dispute arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA). Arbitration shall take place in Delaware or via video conference at your option.

17.3 Class Action Waiver

You agree to resolve disputes with us on an individual basis only, and you waive the right to participate in any class action, collective action, or representative proceeding.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and Storybox Labs LLC regarding the App and supersede all prior agreements, communications, and understandings.

20. Changes to Terms

We may modify these Terms at any time. When we make material changes, we will:

• Update the "Last Updated" date at the top of these Terms
• Notify you via email (if you have provided one) or through the App
• For significant changes, require you to re-accept the Terms

Your continued use of the App after changes are posted constitutes your acceptance of the modified Terms.
